The All India Bar Association (AIBA) has initiated a significant legal move by urging the President of India to make a Presidential Reference to the Supreme Court regarding the Electoral Bonds scheme.

 

The AIBA, representing the youth wing of the Communist Party of India (Marxist), has highlighted the far-reaching implications of the Supreme Court's recent decision invalidating the Electoral Bonds Scheme.

 

In its letter to the President, the AIBA stressed the importance of reevaluating the entire proceedings to ensure justice to all stakeholders involved. The Supreme Court's verdict on February 15, 2024, deemed the Electoral Bonds Scheme as unconstitutional, sparking a cascade of legal and political ramifications.

 

The court's decision also mandated the disclosure of corporate contributions received by political parties, prompting the State Bank of India to expedite the release of crucial information by March 12, 2024. The urgency of the situation underscores the need for a comprehensive review of the case.

 

Dr. Adish Aggarwala, Chairman of AIBA, emphasized the duty to present the facts and seek redress through a Presidential Reference. The AIBA's plea challenges the constitutional validity of the Electoral Bonds Scheme, citing violations of fundamental principles such as secularism and constitutional rights.

 

By invoking Article 143 of the Constitution, the AIBA seeks to address the complex legal and ethical issues surrounding the scheme. The Electoral Bonds Scheme, introduced under the Finance Act of 2017, aimed to streamline political funding mechanisms and promote transparency.
