Communist Youth wing's battle cry: Supreme Court urged to halt CAA enforcement

The Democratic Youth Federation of India (DYFI), the youth wing of the Communist Party of India (Marxist), has taken its opposition to the Citizenship Amendment Act (CAA) to the Supreme Court, seeking an immediate stay on its implementation.

 

In its petition, the federation has argued that granting citizenship based on the religion of immigrants contradicts the fundamental principle of secularism, which is a cornerstone of the Constitution's basic structure.

 

The petition contends that the classification based on religion in the CAA violates Articles 14 and 21 of the Constitution, which guarantee the right to equality and the right to life and personal liberty, respectively.

 

The writ petition filed by DYFI challenges the CAA's provision that uses religion as a criterion for granting Indian citizenship to undocumented migrants from Afghanistan, Bangladesh, and Pakistan.

 

It labels the CAA as "unconstitutional, discriminatory, manifestly arbitrary, unreasonable, and irrational," and urges the apex court to intervene and pass appropriate orders.

 

Earlier on the same day, the Politburo of the Communist Party of India (Marxist) expressed strong opposition to the Citizenship Amendment Act (CAA) rules framed by the Ministry of Home Affairs (MHA) and the subsequent notification issued.

 

The party's statement highlighted that the rules operationalize a discriminatory approach towards Muslims, violating the secular principle of citizenship enshrined in the Constitution.

 

The CAA, introduced by the Narendra Modi government, aims to grant Indian citizenship to persecuted non-Muslim migrants, including Hindus, Sikhs, Jains, Buddhists, Parsis, and Christians, who migrated from Bangladesh, Pakistan, and Afghanistan and arrived in India before December 31, 2014.

 

The move by DYFI to challenge the CAA in the Supreme Court underscores the ongoing legal and political debate surrounding the controversial legislation. As the matter unfolds, it remains to be seen how the apex court will respond to the petition and whether it will intervene in the implementation of the contentious citizenship law.
