The Calcutta High Court has allowed a Kolkata couple to undergo in-vitro fertilisation (IVF), despite being denied due to age restrictions.
The court’s decision came after the couple, from the Kashipur area of Kolkata, approached the High Court following rejection from the state health department.
The couple, married for 30 years, had been unable to have children. At ages 58 and 48, they sought IVF treatment, hoping for a chance at parenthood. However, a fertility clinic refused their request, citing a state rule that men must be under 55 to undergo IVF.
With no exceptions granted by the health department, the couple appealed to the Calcutta High Court. Justice Amrita Sinha ruled in their favor, ordering the clinic to provide necessary assistance and directing the state health department to support the procedure.
“This judgement is not just a ray of hope for this couple but also for many others who have been denied the joy of parenthood due to rigid age limits,” said Justice Sinha.
This IVF ruling has brought hope to those facing similar challenges in Kolkata and beyond.
