The Delhi Court dismissed the bail plea of Tahir Hussain, a key accused in the Delhi riots conspiracy under UAPA, citing his role in the riots and the bar under the UAPA. Hussain was arrested on April 6, 2020, in connection with the North East Delhi riots case, with the charge-sheet filed on September 16, 2020.

The court noted that the accusations against Hussain are prima facie true, based on witness statements and material evidence. Hussain allegedly funded riot activities and used his licensed revolver during the incidents. Furthermore, he reportedly distributed money to protesters and had a significant cash amount allegedly used in the riots.

Despite seeking bail on grounds of parity with other accused, including those granted bail, the court rejected the plea, highlighting the limitations on granting bail under the UAPA. The court emphasised that bail should be rejected if accusations are prima facie true, as observed in this case.

Special Public Prosecutor Amit Prasad opposed the bail application, citing precedents that support rejection of bail if accusations are deemed prima facie true. The court concurred, asserting that given the circumstances and evidence, the accusations against Hussain meet this criterion.

The court's decision underscores the gravity of the allegations against Tahir Hussain and the stringent provisions of the UAPA concerning bail in such cases. Despite his pleas for release, the court's ruling upholds the integrity of the legal process and the need for thorough examination of evidence before granting bail.

Hussain's case remains a focal point in the aftermath of the Delhi riots, reflecting broader concerns regarding communal violence and its legal ramifications. The court's dismissal of his bail plea underscores the seriousness with which such cases are being handled and the commitment to justice for all parties involved.

This development adds another layer to the complex legal proceedings surrounding the Delhi riots, highlighting the challenges in adjudicating cases involving allegations of conspiracy and violence. The decision sets a precedent for similar cases and reinforces the judiciary's role in upholding the rule of law and ensuring accountability for acts of violence.

The court's decision in the ongoing legal proceedings related to the Delhi riots, marks the importance of due process and adherence to legal principles in addressing allegations of conspiracy and violence.
