The Delhi High Court on Monday issued notice to the Delhi Police on a plea filed by Asif Iqbal Tanha challenging the order framing charges against him in connection with the Jamia violence case.
The case pertains to the violence that erupted in the Jamia area of the national capital in December 2019 during protests against the Citizenship Amendment Act (CAA) and the National Register of Citizens (NRC).
Justice Sanjeev Narula issued notice and sought a response from the Delhi Police on Tanha’s plea. The bench has listed the matter for hearing on October 13th along with two other petitions filed by Sharjeel Imam and others.
On March 7th, the Saket court framed charges against Asif Iqbal Tanha, Sharjeel Imam and several other accused for offences including unlawful assembly, rioting, conspiracy, and damaging property by fire and other means.
It has been argued before the High Court that the charges framed are arbitrary and do not take into account a detailed analysis of the facts and circumstances of the case.
The trial court, however, had observed that Asif Iqbal Tanha was named in the FIR and it is alleged that he was leading a mob during the violence.
Sharjeel Imam has also challenged the framing of charges against him, submitting that the same speech cited in the charge sheet is already the subject matter of another FIR registered in 2019 before the Saket court. Charges have already been framed in that matter.
It is further submitted that the same Jamia speech, along with other speeches, is also part of an FIR filed in 2020 which is currently pending before the Karkardooma Court and is at the stage of prosecution evidence.
Sharjeel Imam is also an accused in the larger conspiracy case related to the Delhi riots, in which charges have been framed under the Unlawful Activities (Prevention) Act (UAPA).
