Delhi HC revokes suspension of 7 BJP MLAs of Delhi

The Delhi High Court has overturned the suspension of seven BJP MLAs from the remainder of the Budget session of the Delhi Assembly, a decision made due to alleged disruptions during the Lieutenant Governor's address.

The Delhi High Court has overturned the suspension of seven BJP MLAs from the remainder of the Budget session of the Delhi Assembly, a decision made due to alleged disruptions during the Lieutenant Governor's address.

 

Justice Subramonium Prasad set aside the suspension, with a copy of the judgment awaited. The suspended members, including Mohan Singh Bisht, Ajay Mahawar, and Vijender Gupta, challenged their suspension, arguing that it violated appropriate rules.

 

Senior Advocate Jayant Mehta, representing the MLAs, contended that the suspension was unjust. Senior Advocate Sudhir Nandrajog, representing the Delhi Assembly, defended the suspension, characterizing it as a "self-discipline mechanism."

 

Despite the MLAs' apology to LG Vinai Kumar Saxena, the suspension remained in place, leading to the legal challenge. The BJP MLAs allegedly interrupted Lt Governor VK Saxena's address, focusing on the AAP government's achievements.

 

They claimed bias by the Speaker, alleging selective action against opposition members. The suspension motion was proposed by AAP MLA Dileep K Pandey, leading to the MLAs' removal from the House.

 

The petitioners argued that the Speaker's actions were unconstitutional and violated their rights. During the session, interruptions occurred as Lt Governor Saxena highlighted government strategies. The MLAs interjected with contradictory facts, leading to their removal from the assembly.

 

The High Court's decision to overturn the suspension marks a significant development in the ongoing dispute between opposition and ruling party members in the Delhi Assembly. The ruling underscores the importance of upholding parliamentary decorum while respecting members' rights to dissent.

 

The case, titled AJAY KUMAR MAHAWAR & ORS. V/s LEGISLATIVE ASSEMBLY OF THE NATIONAL CAPITAL TERRITORY OF DELHI, THROUGH SECRETARY & ANR. and other connected matters, sheds light on the complexities of legislative proceedings and the role of the judiciary in ensuring fairness and adherence to constitutional principles.
