The Supreme Court of India has asked the Gujarat government to respond to a petition filed by former Indian Police Service (IPS) officer Sanjiv Bhatt. The petition challenges an order from the Gujarat High Court related to a 1990 custodial death case.
This direction was given on Tuesday by a bench comprising Justices Vikram Nath and Prasanna B Varale, who issued a notice to the Gujarat government regarding Bhatt's plea.
Sanjiv Bhatt, who has had a controversial career in the Indian Police Service, is currently serving a life sentence in connection with the custodial death case. The incident dates back to 1990, during Bhatt's tenure in the Gujarat police force. The case has been a significant point of contention for decades, with various legal battles fought over the years.
In January 2024, the Gujarat High Court dismissed Bhatt's appeal against the trial court's judgement, which had convicted him on several serious charges, including murder, voluntarily causing hurt, and criminal intimidation under the Indian Penal Code. The High Court's decision upheld the trial court's verdict, leading Bhatt to approach the Supreme Court for relief.
Bhatt's petition to the apex court is an attempt to overturn the High Court's ruling, which he argues was unjust and based on flawed legal reasoning. His defence team contends that the evidence presented against him was insufficient to warrant a conviction, and they are seeking to have the case re-examined at the highest judicial level.
The custodial death case in question involves the death of a person in police custody, which allegedly occurred under Bhatt's watch. The case has been one of the many controversies that have surrounded Bhatt's career, which has seen him both lauded for his outspoken nature and criticised for his alleged role in various incidents.
The legal battle over this case has been lengthy, with the Gujarat government and Bhatt's defence team locked in a bitter struggle over the facts and implications of the incident.
Bhatt's supporters argue that he has been unfairly targeted due to his outspoken views and his willingness to take on powerful figures, while his detractors insist that he must be held accountable for his actions during his time in the police force.
The Supreme Court's decision to seek a response from the Gujarat government marks a significant development in this ongoing legal saga. It indicates that the court is willing to consider Bhatt's arguments and that the case may be far from over.
The Gujarat government's response will likely shape the future course of the case, as the Supreme Court will weigh both sides' arguments before making a final ruling.
For Bhatt, this is a critical moment in his quest for justice. A favourable ruling from the Supreme Court could lead to his conviction being overturned and his eventual release from prison. However, the path ahead remains uncertain, as the legal process is complex and fraught with challenges.
