Former BJP MP from Sultanpur, Maneka Gandhi, has initiated a significant legal challenge against the election of Samajwadi Party (SP) MP Ram Bhuwal Nishad. She has filed a petition in the Lucknow bench of the Allahabad High Court, raising questions about the legitimacy of Nishad's election victory.

 

In her petition, represented by senior advocate Prashant Singh Atal, Maneka Gandhi has alleged that Ram Bhuwal Nishad has not been truthful in his affidavit submitted to the Election Commission.

 

According to her, Nishad has 12 criminal cases registered against him, but he only disclosed 8 of these cases in his affidavit. This omission is a serious matter as election affidavits are meant to provide a comprehensive and transparent record of a candidate’s background, ensuring that voters are fully informed about whom they are electing.

 

Maneka Gandhi’s petition aims to highlight this discrepancy and appeal for the annulment of Nishad's election. She contends that by not fully disclosing his criminal record, Nishad has violated the legal and ethical obligations required of electoral candidates, thus compromising the integrity of the electoral process.

 

The stakes are high, given that Ram Bhuwal Nishad defeated Maneka Gandhi in the 2024 Lok Sabha elections for the Sultanpur seat by a margin of 43,174 votes. The election in Sultanpur was notably competitive, featuring a triangular contest between the Bharatiya Janata Party (BJP), the Samajwadi Party (SP), and the Bahujan Samaj Party (BSP).
