The Delhi court on Friday issued a notice on a plea filed by the convicted Hurriyat leader Yasin Malik, seeking permission for his urgent medical treatment.
Malik, who is imprisoned in Delhi’s Tihar jail, had filed a petition in the Delhi high court, saying that he has been on hunger strike since November 1 over the issue.
The Jailed Chief of the Jammu Kashmir Liberation Front (JKLF) is protesting over what he says is the denial of his fundamental rights enshrined in the constitution, including medical treatment and attention to his health issues, by the jail authorities.
As per the plea filed in the court, Malik has sought direction from the jail authority to present records of his medical treatment.
He has sought appropriate directions from the court to ensure that he is referred for proper and necessary medical care at AIIMS or another super-speciality hospital, either in the national capital or in the Kashmir region, to address his deteriorating health conditions.
Furthermore, Malik has asked the court to direct the authorities to produce him before the courts in the national capital territory (NCT) of Delhi whenever he is required to be present in the court.
The bench of Anoop Kumar Mendiratta is scheduled to hear this matter today itself.
Earlier this year, Yasin Malik had also approached the Delhi High Court, claiming inadequate medical treatment and citing serious cardiac and kidney issues.
Meanwhile, the Delhi court is currently examining an appeal by the National Investigation Agency (NIA) seeking the death penalty for the separatist leader Yasin Malik in connection with a terror funding case.
Representing the NIA, Solicitor General Tushar Mehta said Malik was convicted for killing four Indian Air Force personnel and the kidnapping of Mufti Sayeed’s then-home minister's daughter Rubaiya Sayeed.
He said that four terrorists were released in exchange for Rubaiya Sayeed, and later on all of the released terrorists were involved in the 26/11 Mumbai attacks.
The event is often seen as a significant moment in the rise of the deadly militancy phase in Jammu and Kashmir in 1989.
