The Central Board of Indirect Taxes and Customs (CBIC) has clarified the import duty rates for various components constituting the display assembly of mobile phones. Effective immediately, certain parts such as touch panels, cover glass, and LED backlights will now incur a 10 per cent import duty.
However, components like frames, SIM trays, and side keys (such as power/volume buttons) will qualify for a concessional 10 per cent customs duty when attached to the display assembly.
This clarification comes after instances of misdeclaration by importers were detected by the Directorate of Revenue Intelligence (DRI) and other field formations, leading to demand notices being issued.
To address industry concerns and ensure consistency in interpretation, a committee comprising officials from CBIC and MeitY recommended a principle for determining the interpretation of display assembly components.
According to this principle, if certain items/components such as receiver mesh, speaker net, support frame, and antenna pin are fabricated, embedded, fitted, or attached to the assembly, the entire integrated assembly will be treated as a display assembly of a cellular mobile phone, attracting a 10 per cent BCD rate.
Pankaj Mohindroo, Chairman of the Indian Cellular and Electronics Association (ICEA), welcomed the circular, stating that it provides significant relief to the industry and will help avoid unnecessary litigation.
