West Bengal Governor CV Anand Bose has asserted that no inquiry can be conducted against a Governor during their term, citing constitutional protection under Article 361 of the Indian Constitution.
In a statement posted on social media, Governor Bose emphasised that Article 361(2) and (3) shield Presidents, Governors, and Rajpramukhs from criminal proceedings during their tenure. He underscored that this provision prohibits any criminal proceedings or arrest against the Governor while in office.
Governor Bose directed Raj Bhavan staff to disregard any communication from the police regarding the matter, urging them to refrain from providing statements in any form.
The standoff between the Trinamool Congress and Bose revolves around a sexual harassment case, which Bose vehemently denies, asserting that 'Truth Will Triumph'.
Referring to the precedent set in the case of Rameshwar Prasad and Others (VI) v. Union of India and another, Governor Bose highlighted that the Governor enjoys complete immunity.
Responding to queries about police inquiry given the Governor's immunity, Bose clarified that police cannot conduct any investigation or inquiry against him during his tenure.
He emphasised that such actions would undermine the essence of Article 361 and the constitutional immunity bestowed upon the Governor.
