AHCBA slams secret oath of Justice Yashwant Varma

The Allahabad High Court Bar Association (AHCBA) has expressed strong disapproval over what it described as a “clandestine” and “unconstitutional” oath-taking ceremony of Justice Yashwant Varma.

The Allahabad High Court Bar Association (AHCBA) has expressed strong disapproval over what it described as a “clandestine” and “unconstitutional” oath-taking ceremony of Justice Yashwant Varma.

 

The judge, who recently returned to the Allahabad High Court from Delhi, was administered the oath in a private setting, rather than during a formal public function.

 

In a letter addressed to the Chief Justice of the Allahabad High Court, the Bar Association voiced concern about the lack of transparency and protocol surrounding the ceremony. It claimed that the process violated constitutional norms and undermined the credibility of the judiciary.

“This is to bring to your kind notice that the entire Bar Association is at pains to learn about the clandestine manner in which Justice Yashwant Verma has been administered the oath of his office at Allahabad,” the letter stated.

 

The usual tradition of swearing in a judge involves a formal event held in open court, attended by senior judges, members of the Bar, and other dignitaries.

 

The AHCBA maintained that Justice Varma’s oath-taking in chambers, without the knowledge or participation of most stakeholders, was irregular and unacceptable.

 

The association said it had passed a resolution condemning the event. “This oath is against the Constitution of India and, therefore, the members of the Association do not want to be associated with an unconstitutional oath,” the Bar said in its letter.

 

The controversy around Justice Varma has been simmering for weeks. His transfer from the Delhi High Court to Allahabad had earlier triggered protests from lawyers.

 

Many had questioned the decision of the Supreme Court Collegium, particularly in light of an ongoing inquiry into the judge.

 

Last month, a fire at Justice Varma’s residence in Delhi led to the discovery of a large amount of unaccounted cash, prompting the Chief Justice of India to order an in-house investigation.

 

While the details of the probe remain confidential, the Bar Association believes the transfer and subsequent swearing-in should not have proceeded under such a cloud.

 

Anil Tiwari, President of the AHCBA, did not mince words in his remarks to ANI in March. He called the transfer and appointment of Justice Varma “the blackest day in the Indian judicial system”.

 

“March 28 is the blackest day in the Indian judicial system. A man who is facing charges of corruption is going to take an oath in the Allahabad High Court,” he said.

 

The Bar Association further criticised the lack of communication about the oath-taking ceremony.

 

“We are given to understand that the system is taking every step in a fair and transparent manner, but why this oath is not notified to the Bar is a question which again eroded the trust of people in the judicial system,” the statement read.

 

The Supreme Court had earlier directed that Justice Varma should not be assigned any judicial responsibilities following his return to Allahabad. That order remains in effect.

 

The current situation adds to growing public concerns over transparency and accountability in the higher judiciary. The Bar Association's vocal protest serves as a reminder that the legal community continues to play a vital role in upholding constitutional standards.
