Bill seeking precise definition of ‘transgender’ introduced in LS

A Bill seeking to provide a precise definition of the term “transgender” and introduce graded punishments for offences against transgender persons was introduced in the Lok Sabha on Friday by Virendra Kumar.

 

The Transgender Persons (Protection of Rights) Amendment Bill aims to refine the legal definition of “transgender” and strengthen provisions relating to the protection of rights of transgender individuals.

 

According to the statement accompanying the Bill, providing a clear and precise definition is necessary to ensure proper identification and effective implementation of safeguards intended for transgender persons under the existing law.

 

It notes that the protections and benefits under the current legislation are extensive in nature and therefore require a carefully defined framework to ensure that these benefits reach the intended recipients.

 

The proposed amendment emphasises that “such identification cannot be extended based on any acquirable characteristics or personal choice or claimed self-perceived identity of an individual”.

The Bill also proposes graded punishments that would reflect the gravity of harm inflicted upon transgender persons, thereby seeking to strengthen legal protection against offences targeting members of the community.

 

In addition, the draft legislation contains provisions for the designation of an authority that may seek expert advice while dealing with matters relating to identification and implementation of safeguards.

 

The amendment further seeks to empower transgender persons to make consequential changes in official documents, a move intended to facilitate administrative recognition and documentation aligned with their legal identity.

 

The introduction of the Bill marks another legislative step by the government in refining the legal framework governing rights, protections and recognition for transgender persons in the country.
