Chief Justice of India (CJI) Sanjiv Khanna has recused himself from hearing two separate pleas concerning the finalisation of constitutions for the Indian Olympic Association (IOA) and the All India Football Federation (AIFF).
These constitutions were drafted by former Supreme Court judge Justice L. Nageswara Rao.
The CJI, who was sitting alongside Justice Sanjay Kumar, stated at the start of the proceedings that he could not be part of the bench due to his prior involvement in one of the cases at the Delhi High Court.
In light of his recusal, the matter has been scheduled to be heard by a bench headed by Justice P.S. Narasimha on February 10.
During the proceedings, CJI Khanna remarked, “I remember hearing this in Delhi High Court.” His withdrawal underscores the judiciary's emphasis on impartiality and fairness in adjudicating sensitive matters.
Previously, the pleas were heard on March 19, 2024, by a bench led by then-CJI D.Y. Chandrachud. At that time, the court had permitted the AIFF to file objections to the draft constitution proposed by Justice Rao.
The bench had instructed the amicus curiae to update the existing chart to reflect these objections.
The bench had also indicated that the next hearing would address issues related to the constitutions of both the IOA and the AIFF. These deliberations are part of broader efforts to streamline governance and ensure compliance with international standards within India’s sports federations.
The IOA and AIFF constitutions hold significant importance as they shape the framework for governance, transparency, and accountability in these organisations. Justice Rao’s involvement in drafting these documents adds weight to the effort, given his experience and judicial acumen.
