The Karkardooma court in Delhi has dismissed a plea made by former AAP councillor Tahir Hussain, who sought the production of documents from another case.
Hussain, accused in the Delhi riots of 2020, moved the application under Section 91 of the Code of Criminal Procedure, 1973, seeking the production of documents related to statements of a witness in another riot and money laundering case against him.
The court, presided over by Additional Sessions Judge Sameer Bajpai, stated in the order that since the case is at an initial stage and charges are yet to be framed, it is not appropriate to consider the requested statements. The judge emphasised that Hussain had not provided sufficient explanation on how the statements would aid his case.
Special Public Prosecutor Amit Prasad, in his reply, highlighted that seeking documents at this stage, before charges are framed, is an attempt to collect evidence for the accused's defence prematurely.
Considering the overall facts of the case, the court found no merit in Hussain's application and dismissed it accordingly.
Tahir Hussain is among several individuals, including Umar Khalid, Sharjeel Imam, Natasha Narwal, Devangana Kalita, Asif Iqbal Tanha, Safoora Zargar, Ishrat Jahan, Meeran Haider, Abdul Khalid Saifi, who are accused in the larger Conspiracy of Delhi riots case.
The Delhi police have charged them under the provisions of the Unlawful Activities Prevention (UAPA) Act.
