Defamation case: Court reserves order against Atishi, Singh

The defamation complaint states that the defamatory remarks were made by Atishi in the presence of Sanjay Singh, and both are accused of collaborating to tarnish Dikshit’s reputation.

The Rouse Avenue court in New Delhi has scheduled a hearing for April 3, 2025, to decide on the defamation complaint filed by former Congress MP Sandeep Dikshit against AAP leaders Atishi and Sanjay Singh. The court will issue its order on whether to take cognisance of the complaint.

 

Dikshit, represented by advocate Sarim Naved, alleges that Atishi and Singh made defamatory statements about him during a press conference on December 26, 2024.

 

According to Dikshit, the AAP leaders falsely accused him and the Indian National Congress (INC) of accepting large sums of money from the Bharatiya Janata Party (BJP) and colluding with the BJP to defeat AAP in the Delhi state elections.

 

Dikshit contested the Delhi Assembly election in 2024 against Delhi Chief Minister Arvind Kejriwal in the New Delhi constituency. He claims that the defamatory remarks made by Atishi and Singh were baseless and lacked any factual evidence. The allegations were broadcasted live during the press conference and later shared by Atishi on her Twitter account. In her tweet, she claimed, "BJP is helping Congress in the Delhi election." The tweet was viewed over 30,000 times and shared widely across social media.

 

The defamation complaint states that the defamatory remarks were made by Atishi in the presence of Sanjay Singh, and both are accused of collaborating to tarnish Dikshit’s reputation. Dikshit believes this was part of a calculated effort to harm his political and personal image. The complaint further claims that the statements made during the press conference were picked up and reported by national newspapers, increasing their impact.

 

Dikshit alleges that the defamatory remarks have severely damaged his reputation, both as a political figure and as an individual. He argues that Atishi and Singh’s actions were intended to undermine his character and credibility. The complaint accuses the two AAP leaders of committing defamation under Section 356 of the BNS, 2023. Dikshit claims that a legal notice was sent to Atishi and Singh on January 2, 2025, but the tweet containing the defamatory statements continues to be available online.

 

On January 16, 2025, the court had issued notices to both Atishi and Singh, asking them to respond before any decision on taking cognisance of the defamation complaint.

 

The next hearing is scheduled for April 3, 2025, when the court will decide whether to proceed with the case.
