Delhi HC notice to CBI on Dhall plea in excise case

The Delhi High Court on Tuesday issued notice to the Central Bureau of Investigation (CBI) on a plea filed by businessman Amandeep Singh Dhall challenging the charge sheet and summoning order issued against him in connection with the Delhi excise policy case.

The Delhi High Court on Tuesday issued notice to the Central Bureau of Investigation (CBI) on a plea filed by businessman Amandeep Singh Dhall challenging the charge sheet and summoning order issued against him in connection with the Delhi excise policy case.

 

Justice Ravinder Dudeja sought a response from the CBI and listed the matter for hearing on November 25. Special Public Prosecutor (SPP) D P Singh appeared on behalf of the investigating agency.

 

During the hearing, the CBI questioned the maintainability of the petition, arguing that Dhall had approached the court two years after cognisance was taken. “The cognisance order could have been challenged at the time. Now, after two years, they want to file a quashing petition,” Singh submitted.

 

Dhall, represented by Advocate Adit S Pujari, contended that the plea does not challenge the FIR but specifically contests the charge sheet and summoning order. Pujari argued that Dhall was not part of the alleged conspiracy involving other accused individuals.

 

The counsel further pointed out that the CBI had filed a supplementary charge sheet against Dhall in 2023, after which cognisance was taken and summons were issued. In July 2024, the investigation was completed, and another supplementary charge sheet was filed. By February 2025, the agency had submitted a list of unrelied-upon documents, he said. “We are not seeking a stay,” Pujari added.

 

At the hearing, the bench asked the CBI whether its objection rested solely on the issue of limitation. The agency maintained that the plea was not maintainable and stressed that the court had a narrow scope for intervention at this stage.

 

The case concerns alleged irregularities in the Delhi excise policy. Former Delhi Chief Minister Arvind Kejriwal, former Deputy Chief Minister Manish Sisodia and several others are also accused in the matter.
