Plea seeking restoration of statehood in J&K filed in SC

Mentioning the successful conduct of the recent Assembly polls in the Valley, the petition filed by advocate Soyaib Qureshi before the Supreme Court stated that the formation of the legislative assembly before the restoration of the statehood would violate the basic idea of federalism enshrined in the Indian Constitution.


An application has been filed in the Supreme Court of India seeking restoration of the statehood of Jammu and Kashmir (J&K) within two months.

 

According to the plea filed by college teacher Zahoor Ahmad and activist Khurshid Ahmad Malik the failure to restore statehood to the erstwhile state of Jammu and Kashmir was having adverse effects on the residents of the UT.

 

Mentioning the successful conduct of the recent Assembly polls in the Valley, the petition filed by advocate Soyaib Qureshi stated that the formation of the legislative assembly before the restoration of the statehood would violate the basic idea of federalism enshrined in the Indian Constitution.

 

The petitioners state that since the recently concluded assembly polls were conducted peacefully there would be “no security concerns” in case the top court passed the direction to restore statehood to Jammu and Kashmir within a time-bound period as it did while ruling on Assembly polls last year.

 

The petition also contends that the conversion of the erstwhile state into two Union territories has resulted in J&K being given a lesser form of elected democratic government, which is to be formed after the Assembly election results are announced on October 8.

 

One of the litigants said the state of J&K had a special federal relationship with the Union of India. Thus, it was of the utmost importance that its status of the UT is restored immediately to maintain that relationship.

 

This will allow the people of J&K to “enjoy their autonomy and self-respect in their identity and also play an important part in the overall development of the country.”

 

It's important to mention that the Central government led by Prime Minister Narendra Modi, along with Union Home Minister Amit Shah, had repeatedly said that statehood of J&K would be restored soon.
