Senior Congress leader Rahul Gandhi will appear in person before the MP/MLA court in Chaibasa, West Singhbhum district of Jharkhand on 6 August.
Rahul’s lawyer Dipankar said that he was earlier asked to appear in person on 26 June, for which a non-bailable warrant was issued against him. Rahul Gandhi had filed a petition in the Jharkhand High Court seeking exemption from appearance on 26 June.
During the hearing on Tuesday, Rahul Gandhi's lawyer sought permission for him to appear on 6 August instead of 26 June. The court of Justice Anil Kumar Chaudhary of the High Court agreed to this and ordered the non-bailable warrant to be postponed until 6 August.
The case relates to a speech given by Rahul Gandhi against the BJP during a Congress session on 28 March 2018. BJP leader Pratap Kumar filed a defamation case against Rahul Gandhi in the Chaibasa Court in this regard.
Initially, the case was transferred to the MP-MLA Special Court in Ranchi on the orders of the Jharkhand High Court on 20 February 2020. Later, the High Court sent the case back to the Special Court in Chaibasa.
Despite receiving the summons, Rahul Gandhi did not appear in court. Subsequently, the court issued a bailable warrant, but he still failed to appear. On this basis, the court issued a non-bailable warrant against him.
Rahul Gandhi challenged the non-bailable warrant in the High Court, but it was rejected. Additionally, a petition was filed on behalf of Rahul Gandhi seeking exemption from personal appearance under Section 205 of the CrPC, which was also rejected by the lower court.
