The Supreme Court on Monday dismissed a public interest litigation filed by one Pinakpani Mohanty seeking a declaration that Netaji Subhash Chandra Bose's Indian National Army (INA) secured India's independence.
A Bench comprising Chief Justice of India (CJI) Surya Kant and Justice Joymalya Bagchi observed that the court cannot delve into such issues.The court also criticised the petitioner for approaching it again on this matter, despite a similar plea being dismissed in 2024. The Bench warned that it would ban entry of the petitioner into the court if he came up with plea again.
The Bench observed that the petition appeared to be an attempt to gain publicity and noted that a similar public interest litigation filed earlier by the same petitioner had already been rejected."You had earlier also filed a similar plea?" CJI Kant remarked."Yeh baar alag hai (this one is different)," the petitioner, Pinakpani Mohanty, replied.
During the hearing, the Chief Justice remarked, 'Supreme Court mein entry band kar denge', warning the petitioner who appeared in person. The petitioner had sought a declaration that Netaji Subhash Chandra Bose be recognised as the 'National Son' and that the foundation day of the Indian National Army on October 21, 1943, along with Netaji's birth anniversary on January 23, 1897, be observed as National Days.
The court, however, was not inclined to entertain the plea further. The Bench also warned that it would ban the petitioner from approaching the court if he continued filing frivolous petitions."Entry ban karwa denge tumhara Supreme Court mein ab. Pehle bhi same plea dismiss kar chuke hai (We'll ban you from the Supreme Court, a similar plea was dismissed earlier as well)," the Court said.
The plea before the Court had sought directions to credit India's independence from British colonial rule to revolutionaries who did not follow 'Ahimsa' (peaceful methods to resist colonial rule as advocated by Mahatma Gandhi) but the INA, led by Netaji Subhas Chandra Bose.
