Tribunal led by Justice Naveen Chawla to determine Jamaat-e-Islami's status in J&K

A Tribunal, under the leadership of Justice Navin Chawla from the High Court of Delhi, has been established by the Ministry of Home Affairs to determine the status of the Jammu and Kashmir Jamaat-e-Islami.

 

This decision comes after the Union government imposed a five-year ban on the Jamaat-e-Islami Jammu and Kashmir, citing concerns about activities that could undermine internal security and public order, potentially jeopardising the unity and integrity of the nation. Subsequently, the ban was extended for another five years.

 

The Jamaat-e-Islami, however, has refuted allegations of involvement in activities deemed anti-national or subversive. They assert a membership of 6000 individuals within the state and highlight their engagement in various social endeavours such as managing schools, orphanages, and aid agencies.

 

In response to claims about their political stance, the Jamaat clarified that while they neither oppose nor support the election process, they refrain from voting and abstain from participating in election boycott campaigns.

 

With the establishment of this Tribunal, a thorough and impartial examination will occur to evaluate the validity of these assertions and determine the legal status of the association. The Ministry of Home Affairs, in its notification, emphasized the necessity for such scrutiny in light of the association's designation as unlawful, as outlined in previous official notices.

 

Consequently, according to the authority granted by relevant sections of the Unlawful Activities (Prevention) Act, 1967, the Central Government has constituted the Unlawful Activities (Prevention) Tribunal, chaired by Justice Navin Chawla, to deliberate on whether there exist sufficient grounds to declare the Jammu and Kashmir Jamaat-e-Islami as an unlawful entity.
