The Rouse Avenue court on Saturday directed Delhi Police and counsel for complainants to file a copy of the petition filed in the Supreme Court in the Brij Bhushan Sharan Singh case.
The matter is related to a FIR lodged by Delhi Police after women wrestlers approached the Supreme Court, accusing BJP MP Brij Bhushan Sharan Singh of sexual harassment. The case has reached the stage of framing charges, and the court is currently in the process of examining evidence and arguments from both sides.
Delhi police and the counsel for the complainants have submitted some documents, and the court has granted time to the counsel for the accused to file rebuttal submissions.
Additionally, the Delhi police is expected to file its rebuttal submissions soon. The court has requested a copy of the petition filed in the Supreme Court on behalf of the women wrestlers, and the matter has been scheduled for a hearing on March 27.
In previous hearings, the court had sought clarification on the point of territorial jurisdiction. The Additional Public Prosecutor highlighted that the alleged offences committed by the accused were continuous in nature, and there was commonality among them.
The court is tasked with determining whether there is sufficient evidence to frame charges against the accused at this stage of the proceedings.
The defence counsel, represented by Advocate Rajiv Mohan, along with Rishabh Bhati and Rehan Khan, argued that the oversight committee formed by the government under the provisions of the PoSH Act had recorded statements related to the allegations made by the complainants.
They emphasized the importance of considering the statements recorded before the oversight committee as part of the judicial record.
Furthermore, the defence counsel argued against the delay in reporting the alleged offences, pointing out contradictions in the statements provided by the complainants. They also raised concerns about the jurisdiction of the court and the time limitations for filing chargesheets. The court is currently hearing arguments on framing charges afresh, taking into account all the evidence and submissions presented by both sides.
