The Supreme Court has decided to adjourn the hearing on Vijay Nair's bail plea in connection with the Delhi Excise Policy case. Vijay Nair is a businessman who is currently embroiled in a money laundering case related to alleged irregularities in the Delhi Excise Policy.

 

The bench, comprising Justices Hrishikesh Roy, Sudhanshu Dhulia, and SVN Bhatti, agreed to adjourn the matter following a request from Nair’s counsel, who sought additional time to add more documents to the case.

 

Vijay Nair's legal team, led by advocate Binisa Mohanty, has challenged a previous decision by the Delhi High Court, which denied bail to Nair in the liquor policy case. This denial followed an earlier rejection of his bail plea by the trial court.

 

Nair has consistently argued that he was merely the media and communications in charge of the Aam Aadmi Party (AAP) and had no role in drafting, framing, or implementing the excise policy. He contends that the allegations against him are baseless and politically motivated.

 

In his earlier bail plea before the trial court, Nair claimed that his arrest by the Enforcement Directorate (ED) on November 13, 2022, was illegal and driven by extraneous considerations, particularly as the special court was about to rule on his bail plea in the related corruption case being investigated by the Central Bureau of Investigation (CBI).

 

The ED has alleged that Nair, acting on behalf of AAP leaders, received kickbacks amounting to Rs 100 crore from a group referred to as the South Group. Nair, who is the former Media and Communication Charge of the AAP and the former CEO of the entertainment and event management firm Only Much Louder, has denied these accusations.

 

Both the ED and the CBI have accused Nair and others of committing irregularities while modifying the excise policy. They allege that undue favours were extended to licence holders, the licence fee was waived or reduced, and the L-1 licence was extended without the necessary approval from the competent authority. The L-1 licence is a critical permit granted to business entities with at least five years of experience in wholesale liquor distribution in any state.

 

The case has garnered significant attention due to its political implications and the involvement of high-profile individuals. The allegations suggest that the excise policy was manipulated to benefit specific groups and individuals, undermining the regulatory framework and causing financial loss to the state. The controversy has also raised questions about the integrity and transparency of the policy implementation process in Delhi.

 

Nair's legal team is preparing to present additional documents to support their case, aiming to overturn the previous court decisions and secure bail for Nair.
