Bollywood actor and KPH Dream Cricket Pvt Ptd director Preity Zinta has challenged an order of a trial court, which dismissed her civil suit against co-directors Mohit Burman and Ness Wadia. Zinta filed a separate petition in the court of the Additional Sessions Judge, seeking stay on the trial court order during the pendency of her plea.
The Civil Judge, Chandigarh had dismissed Zinta’s suit on May 31 which sough to declare an extraordinary general meeting of the company that took place on April 21 as illegal and invalid. The Bollywood actor reasoned that Mohit Burman conducted the meeting with the active support of Ness Wadia in violation and total disregard of the provisions of the Companies Act, 2013 and the Articles of the company.
She also sought court orders to restrain the company, Mohit Burman and Ness Wadia from giving effect to any resolution that might have been passed during the meeting and also to restrain one Muneesh Khanna from as a director of the company.
The trial court, however, dismissed her suit, maintaining that it did not have the jurisdiction to take it up. Zinta has 23 per cent shareholding in the company that holds a franchise of the IPL and owns the team Punjab Kings. The court has, meanwhile, sent notices to the firm, Mohit Burman, Ness Wadia, Karan Paul and Muneesh Khanna for Friday.
