The Calcutta High Court announced on Wednesday that it will hear the Central Bureau of Investigation (CBI), the victim’s family, and the convict before deciding on the admission of an appeal filed by the West Bengal government regarding the adequacy of the sentence in the RG Kar hospital rape-murder case.
The court scheduled the matter for hearing on Monday.
The CBI opposed the state's right to file an appeal, asserting that as the prosecuting agency, it holds the right to file an appeal on grounds of sentence inadequacy.
On Monday, the Sealdah court sentenced Sanjay Roy to life imprisonment till death for the rape and murder of an on-duty doctor at RG Kar Medical College and Hospital on August 9.
A division bench, led by Justice Debangshu Basak, stated that it would consider arguments from the CBI, the family of the victim, and the convict’s legal representatives before making a decision on the admission of the state government's appeal.
The West Bengal government has moved to the high court, seeking the death penalty for Sanjay Roy.
Speaking to mediapersons, the father of the victim expressed disappointment with the sentence, stating, “Let us get the order copy tomorrow, we will go through it and then decide what we want to do. She (chief minister Mamata Banerjee) does not have to do anything in a hurried manner. Whatever the chief minister has done till date, she should not do any further.”
The father criticised the West Bengal CM, alleging that the accused received a life sentence due to inadequate evidence provided by the CBI.
“She can say a lot of things but she only tampered with evidence… the then CP and others, they had tampered with it. Could she not see all that from the beginning?" the 31-year-old doctor’s father said.
