A Delhi court is expected to rule on November 20 on whether the terror funding case involving jailed MP Engineer Rashid will be transferred to the designated MP/MLA court.
Additional Sessions Judge Chander Jit Singh indicated the case might be assigned to a special court designed for lawmakers such as Rashid.
During the latest hearing, the matter was adjourned after the National Investigation Agency (NIA) sought additional time for argument.
The judge, who earlier reserved his decision on Rashid's bail, directed that the jurisdiction issue be resolved first to determine if the case will remain with the current court or be shifted to the designated MP/MLA court.
Consequently, the bail order has been scheduled for November 19.
The court remarked, “Since we are considering the jurisdiction issue – whether the matter will be heard by this court or the designated MP/MLA court of the National Investigation Agency (NIA), keep the bail order post that.”
Rashid surrendered to Tihar Jail authorities on October 28 after his interim bail expired. On September 10, the court had granted him interim bail, permitting him to campaign for his Awami Ittehad Party during the recent assembly elections.
The bail was subsequently extended until October 28, given his father’s ailing health and after the NIA confirmed his documents.
The Baramulla MP has been detained since 2019 after his name emerged during an NIA probe. He was arrested based on claims by Zahoor Watali, the main accused, who identified Rashid as a conspirator in the alleged terror funding case.
Rashid remains incarcerated under the Unlawful Activities (Prevention) Act (UAPA) related to the 2017 terror funding allegations.
