Mother denied bail in sexual exploitation case

The Uttarakhand High Court has rejected the bail petition of a woman who was accused of forcing her 13-year-old daughter into sexual acts with a co-accused. Justice Alok Mehra declined relief to the accused woman, citing the seriousness of the allegations and the possible adverse impact on the minor’s well-being.

 

The case came to light when the victim girl’s father registered a complaint in Haridwar, alleging that the woman compelled the minor to consume alcohol and made her travel to multiple cities in connection with the offences.

 

According to the prosecution, the minor was taken to Haridwar, Agra, Ghaziabad and Vrindavan, where the alleged her sexual exploitation continued over a period of time.

 

During the hearing, the defence argued that the girl was enrolled in a residential school during the relevant period and pointed to a delay of nearly five months in the registration of the FIR, contending that such inconsistencies weakened the prosecution’s case.

 

The state government opposed the bail application, asserting that the allegations were grave and warranted continued custody of the accused.

 

The court observed that issues relating to delay in lodging the FIR or alleged inconsistencies in evidence are matters to be examined during trial and cannot be adjudicated at the stage of bail.

 

Justice Mehra further noted that although the accused has been in judicial custody since June 2025, the duration of jail time alone cannot be considered sufficient grounds for granting bail in cases involving serious offences. Rejecting the plea, the High Court said there was a possibility of the accused influencing witnesses.
