Punjab and Haryana HC bars AI use in judgments

A letter issued by the High Court Registrar-General on Monday to all district and sessions judges in Punjab, Haryana and Chandigarh stated that the Chief Justice has asked them “to direct the judicial officers working under your control not to use Artificial Intelligence (AI) tools.”

The Punjab and Haryana High Court has ordered judicial officers to avoid using AI tools like ChatGPT, Gemini and Copilot to write judgements and conduct legal research.

 

A letter issued by the High Court Registrar-General on Monday to all district and sessions judges in Punjab, Haryana and Chandigarh stated that the Chief Justice has asked them “to direct the judicial officers working under your control not to use Artificial Intelligence (AI) tools.”

 

The tools include but are not limited to Gemini, ChatGPT, Microsoft Copilot, Meta, etcetera, for writing judgements and legal research. Anyone found involved in such practice from now on would invite action, it added.

 

Earlier, the Gujarat High Court had prohibited the use of AI for any form of decision-making, judicial reasoning, order drafting, judgement preparation, bail or sentencing consideration, or any substantive adjudicatory process.

 

According to the Gujarat High Court’s AI policy, unveiled at a conference of district judiciary judges on Saturday, artificial intelligence should be used to improve the speed and quality of justice delivery, rather than as a replacement for judicial reasoning.

 

While the use of AI is transforming STEM fields and the research world, its use in social sciences and legal matters is deemed unethical and, in some forms, illegal.

 

The use of AI, especially in fields like law and security matters, has significant limitations or drawbacks since legal and judicial matters continuously evolve and remain outside AI’s scope.
