SC to hear J&K statehood plea on Oct 10

The Supreme Court is set to hear petitions seeking the restoration of Jammu and Kashmir's statehood on Friday. The petitions are listed at serial number 17 before the Court of the Chief Justice of India (CJI).

 

“The case about the Statehood of Jammu and Kashmir is listed for hearing on October 10 before a bench headed by the Chief Justice of India,” said the counsel representing the petitioners on Thursday.

 

Advocate Soayib Qureshi added, “The Union of India has not yet issued any response on the matter.”

 

Earlier, on August 14, during the hearing of a petition to restore statehood to the erstwhile state, the Supreme Court ruled that the real situation on the ground must be considered before the restoration is granted.

 

The bench, headed by CJI BR Gavai, said incidents such as the Pahalgam attack cannot be overlooked in this matter. “You must also take into account the ground realities; you cannot ignore what happened in Pahalgam,” the bench said.

 

The petitioners have claimed that the sustained delay in restoring statehood violates the principle of federalism, which is part of the basic structure of the Constitution. They have also claimed that no concrete steps have been taken to lay out a clear timeline or implement the Supreme Court’s December 2023 directive.

 

“Statehood shall take place at the earliest and as soon as possible,” the SC had said.

 

Amid legal constraints and continuous delays, Jammu and Kashmir is presently functioning under a dual control system, where the Lieutenant Governor oversees security and administrative affairs, while the elected government handles civic and governance matters.
