The Uttarakhand High Court has issued special guidelines to ensure speedy justice for armed force personnel and their families.
The guidelines instruct all subordinate courts in the state to identify such cases and give them priority for disposal.
To ensure proper implementation of the guidelines, the High Court directed that judicial officers be trained on legal provisions related to defense personnel. The notification, effective immediately, requires all courts to first identify pending cases involving members of the armed forces.
Courts are also asked to follow the relevant provisions of the Indian Military (Litigation) Act, 1925, the Army Act, 1950, the Air Force Act, 1950, the Navy Act, 1950, and other applicable laws while hearing such cases.
A key point in the guidelines is that if the personal presence of a defense personnel is needed during proceedings, courts must schedule hearings according to their availability to avoid unnecessary delays.
The guidelines also state that in cases where arrest or attachment of property of serving or retired defense personnel is sought, prior intimation to the Commanding Officer or the District Sainik Board is mandatory.
