Uttarakhand Waqf board approaches SC to defend Waqf Act

The Uttarakhand Waqf Board, which has been a strong supporter of the Waqf (Amendment) Act, has filed an application in the Supreme Court to seek permission to intervene in a writ petition. 


The petition was filed by AIMIM MP Asaduddin Owaisi, who is challenging the constitutional validity of the Act. The application was submitted on Monday, accompanied by an affidavit, on behalf of the Uttarakhand Waqf Board.


The Waqf Board, which is responsible for the administration and management of Waqf properties in Uttarakhand, believes it is an essential party to the case due to its direct stake in the matter. The Board argued in its application that it should be allowed to assist the court by making relevant legal and factual submissions related to the issues raised in the petition.


According to the Board, Uttarakhand currently has a total of 5,317 Waqf properties. In its application, the Board expressed concern over the recent surge in Waqf properties within the state, raising doubts about the authenticity of some of these donations.


 Additionally, the Board highlighted the issue of encroachments, noting that many Waqf properties have been unlawfully occupied by third parties. The Uttarakhand Waqf Board has requested the court to consider these factors in its deliberations.
