BPSC Paper Leak: Supreme Court advises petitioner to approach Patna High Court for faster resolution on cancellation of 70th preliminary exam

The Supreme Court on Tuesday declined to hear a plea seeking the cancellation of the Bihar Public Service Commission's (BPSC) 70th Combined Competitive Exams (preliminary) over allegations of a paper leak. The court suggested the petitioner should first approach the Patna High Court for relief.


A three-judge bench, led by Chief Justice of India Sanjiv Khanna, emphasised that the Supreme Court cannot act as the first point of appeal in every matter. Justices Sanjay Kumar and KV Viswanathan were also part of the bench.


The petitioner's counsel, representing Anand Legal Aid Forum Trust, highlighted the police lathi charge on protestors opposing the alleged BPSC paper leak. He argued that the Bihar Police had used excessive force near the Patna High Court Chief Justice’s residence, which warranted suo motu action by the high court.


Despite these arguments, the Supreme Court declined to comment on the police action or the protests, stating that the matter should be handled by the Patna High Court.

The petitioner further pointed out that competitive exam paper leaks, including the BPSC paper leak case, were becoming a common issue and urged the Supreme Court to intervene.

 

However, the bench firmly stated, "It will be appropriate and more expeditious for the petitioner to approach the Patna High Court under Article 226," and dismissed the plea.


The BPSC exam row has sparked widespread protests across Bihar, with several groups demanding the cancellation of the exam. Political figures, including Prashant Kishor, have weighed in on the controversy, criticising the handling of the issue by the Bihar Public Service Commission and state authorities.
