The Bidhannagar Commissionerate has registered an FIR against Abhishek Banerjee, General Secretary of the Trinamool Congress (TMC), under multiple sections, including several non-bailable charges, for allegedly making provocative remarks during his election campaign.
According to police sources, the case was lodged at the Bidhannagar Cyber Crime Police Station. The FIR was filed based on a complaint submitted by social activist Rajiv Sarkar, who accused Banerjee of delivering statements during campaign rallies that could incite unrest and deepen divisions within society.
The complaint specifically references remarks allegedly made against Union Home Minister Amit Shah. It further alleges that the speeches, delivered across multiple public platforms, were provocative in tone and had the potential to disturb communal harmony. Supporting materials, including video links and excerpts from campaign speeches, were submitted to the police along with a request for investigation.
Following a preliminary examination, the police registered the FIR under five sections of the Bharatiya Nyaya Sanhita. These include:
Section 192 (incitement of unrest) — bailable
Section 196 (promoting enmity between groups) — non-bailable
Section 351(2) (criminal intimidation and threats) — non-bailable
Section 353(1)(c) (spreading false or misleading information)
Additionally, provisions under the Representation of the People Act, 1951—Sections 123(2) and 125—have also been invoked, relating to corrupt practices and promoting enmity during elections.
The development has triggered sharp political reactions. Opposition leaders argue that the situation stems from the crossing of acceptable limits during campaign rhetoric. Meanwhile, sections of the TMC have dismissed the allegations as politically motivated, alleging a conspiracy orchestrated by rival parties.
As of now, no official response has been issued by Abhishek Banerjee regarding the FIR.
