Trinamool Congress (TMC) MP Abhishek Banerjee has approached the Calcutta High Court challenging a lower court order that permitted the Criminal Investigation Department (CID) to collect his voice sample in connection with a case linked to alleged provocative remarks made during an election campaign.
Banerjee moved the High Court on Thursday after the Bidhannagar Court granted permission for the collection of his voice sample. The matter was mentioned before the bench of Justice Kaushik Chanda by his counsel, Ayan Bhattacharya, who questioned the necessity of the procedure.
Arguing before the court, Bhattacharya submitted that Banerjee had not denied that the voice in question was his and, therefore, the collection of a voice sample was unnecessary.
The High Court has permitted the filing of the petition, and the matter is likely to be heard next week.

The case stems from a complaint lodged at the Bidhannagar Cyber Police Station over alleged provocative remarks made during an Assembly election campaign, particularly concerning the playing of DJ music after the declaration of election results. The CID subsequently took over the investigation.
Earlier, the Bidhannagar Court directed Banerjee to appear on June 30 for the collection of his voice sample in the presence of a magistrate and a forensic expert. The CID had approached the court seeking permission for the procedure, which was subsequently granted.
According to reports, CID officials visited Banerjee’s residence in Kalighat on Wednesday night to serve a notice informing him that the voice sample collection would take place next Tuesday.
Following the notice, Banerjee filed a petition before the Calcutta High Court challenging the lower court’s order, setting the stage for a legal contest over the necessity and validity of the voice sample in the ongoing investigation.
