J&K reservation report awaits govt clearance

In its reply to a question submitted by the People’s Conference Chief, Sajad Gani Lone, and the independent MLA Shabir Ahmad Kullay, the minister in charge of the General Administration Department replied in the Assembly that the cabinet sub-committee, after due consultations with stakeholders, had submitted its report to the Council of Ministers.

The Jammu and Kashmir Government on Thursday said the cabinet sub-committee on reservation has submitted its final report to the Council of Ministers for approval.

 

It said that finalisation of the report shall take place immediately after obtaining the requisite permission from the competent authority.

 

In its reply to a question submitted by the People’s Conference Chief, Sajad Gani Lone, and the independent MLA Shabir Ahmad Kullay, the minister in charge of the General Administration Department replied in the Assembly that the cabinet sub-committee, after due consultations with stakeholders, had submitted its report to the Council of Ministers.

 

The report should be finalised in due course of time after final requisite permission from the competent authority was received, the minister said.

 

The minister said the existing reservation policy broadly aligns with constitutional provisions and judicial principles, including those laid down in the Indira Sawhney vs. Union of India (1992) judgement.

 

In the Indira Sawhney versus Union of India judgement, the Supreme Court has held that reservations should ordinarily not exceed 50 per cent of the available vacancies.


However, the minister replied that “it is also clarified that this ceiling is not a final rule and may be relaxed in extraordinary circumstances, where conditions and peculiar facts of a particular region or state justify such a department.”


The government, however, said it didn’t maintain region-wise or district-wise details of selections for junior-scale posts in the Jammu and Kashmir Administrative Service, Jammu and Kashmir Police (Gazetted) Service, and Jammu & Kashmir Accounts Service, saying it didn’t maintain such data.


Meanwhile, youth in the UT, particularly in the Kashmir region, have been protesting against the proposed modifications that seek to provide more than 50 per cent reservation to the category aspirants, leaving out fewer seats to be filled by open merit candidates.


Besides, Jammu and Kashmir has been witnessing a surge in unemployment over the past decade.


In a separate response by the government, there are currently 3.61 lakh unemployed youth in Jammu and Kashmir, data that only includes the candidates registered with the government.
