Uttarakhand HC grants bail to Nainital dairy union chief

The Uttarakhand High Court has granted bail to Mukesh Singh Bora, the president of the Nainital Milk Union, who was arrested last year on charges of rape and molestation. 


Justice Alok Mehra, while hearing the bail plea, issued the order on March 19, imposing specific conditions on the accused to ensure the integrity of the ongoing investigation. Bora has been directed to cooperate fully with the probe and is strictly prohibited from influencing the survivor, either directly or indirectly. 


Additionally, the court has mandated that he surrender his passport or submit an affidavit if he does not possess one.


The case against Bora was filed based on allegations made by a widow employed with the Nainital Milk Union. She accused him of repeatedly raping her under the pretext of offering her a permanent job. 


Furthermore, she claimed that he also molested her daughter, leading the police to book him under sections of the Indian Penal Code (IPC) and the Protection of Children from Sexual Offences (POCSO) Act.


During the hearing, Bora’s defense argued that the FIR was lodged after a significant delay and pointed out inconsistencies in the survivor’s statements, which they claimed raised doubts about the credibility of the allegations. On the other hand, the prosecution contended that there was substantial evidence suggesting that Bora had not been cooperating with the investigation. 


Despite these arguments, the High Court granted him bail with strict conditions to ensure he remains accountable during the legal proceedings.
