The Uttarakhand High Court has upheld the compensation given to the family of an Indian Army jawan who lost his life in a road mishap in 2011, rejecting an appeal filed by the Uttar Pradesh State Road Transport Corporation (UPSRTC).
A single bench of Justice Pankaj Purohit upheld the tribunal’s order directing the corporation to pay Rs 28.91 lakh, along with interest, to the deceased soldier’s family. The court observed that the accident took place because of the negligence of the bus driver when the UPSRTC bus rammed into a parked truck.
Naik Ganesh Singh of the 5th Guards Regiment was going in a corporation bus from Bareilly in Uttar Pradesh to Tanakpur in Uttarakhand on July 7, 2011, when the driver lost control and the bus crashed into a truck parked on the roadside. Singh suffered serious injuries and later died during treatment.
The transport corporation claimed that the driver swerved to save a cyclist and that the truck was wrongly parked. However, the court rejected the argument, noting that the driver was not produced as a witness and no evidence was submitted to support the claim.
